ELITE BUSINESS CAPITAL LLC is a business funding brokerage that connects businesses with funding options, including but not limited to Merchant Cash Advances, Small Business Loans, Equipment Financing, Business Lines of Credit, Invoice Financing, and Commercial Mortgages. We act as a facilitator and broker — we do not directly lend funds to applicants. All funding decisions are made by our network of third-party lenders and funding partners.

IN NO EVENT SHALL ELITE BUSINESS CAPITAL LLC'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE AMOUNT YOU PAID TO ELITE BUSINESS CAPITAL LLC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
You agree to defend, indemnify, and hold harmless ELITE BUSINESS CAPITAL LLC and its members, officers, employees, agents, and contractors from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including attorneys' fees) arising from: (a) your use of and access to the Site or Services; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any claim that your submitted content caused damage to a third party.
